Pools in Arizona are incredibly common. Many houses, apartment complexes, and hotels have pools on their grounds, which makes pool safety a major concern. One measure taken to create a safer environment is requiring them to have some type of barrier around them. These pool barrier regulations are not only applicable to homes with backyard pools or other residential properties. Commercial properties such as apartments and hotels are held to the exact same standards when it comes to pool fencing and safety. In 1991 Arizona passed a swimming pool fence law that covers the entire state, and it allows counties and cities to make adjustments - as long as these changes meet the standards of the state or make them even stricter. The law focuses on setting standards for the following aspects of pool barriers: fence height, structural features of the fence, and gate requirements. All of these standards are put in place to create the safest environment surrounding a pool, and they are applied to commercial properties with as much rigor as residential properties. The pool fencing must be at least five feet high and must be constructed of material sturdy enough that it cannot be pulled or broken down by hand. The fences cannot be constructed with any handholds or footholds that could be used to climb over the fence. If the fence is constructed with posts or bars, they cannot have a space more than four inches between each one in order to prevent small children from slipping through the gap. Pool gates must be self-closing and self-latching, and the latch must be at least fifty-four inches above the ground. The gate must also open outward from the pool. These requirements apply to “a swimming pool, or other contained body of water that contains water eighteen inches or more in depth at any point and that is wider than eight feet at any point and is intended for swimming” (from http://www.azleg.state.az.us/ars/36/01681.htm), whether it is below or above ground, according to the very first section of the law. There is no exception made for commercial properties. In fact, it is very important that commercial properties like apartment complexes and hotels meet these regulations. With more people living in the complex than a typical residential property and with higher traffic around the pool, a secure and legal pool barrier can make a huge difference in child safety. Not only is it the law, but also a pool barrier that is up to code can provide a secondary line of defense against accidental drowning for everybody.
