In the case of Pennington vs. State, the District Court of Appeal ruled as follows: The District Court reversed defendant's conviction for DUI manslaughter, remanding for an amended judgment and sentence for a DUI, & affirmed a judgment and sentence for leaving the scene of an accident with a death. Defendant had appealed, contending the trial court erred in denying his motion for judgment of acquittal because his reasonable hypothesis of innocence concerning the nature of the accident was not rebutted along with denying his request for a mistrial on the grounds of juror misconduct. The circuit court ruled there wasn't proof to show that defendant's drunk driving caused or contributed to the other driver's death. The prosecution is required to prove that fact beyond a reasonable doubt under Florida Law.
