Divorce may be loosely used today as a way to end a marriage but in truth, it's the last stage for the dissolution of marriage. Some do not allow divorce in any way while others demand a tougher set of regulations just like annulment. People who want to terminate their marriage should first understand all the options that are offered to them. Couples may either select divorce, legal separation or annulment. Divorce, as mentioned before, terminates the marriage and the legal duties and obligations which a couple has for each other. It cancels the marital status of the parties involved and enables them to get married again should they wish. It is far easier to obtain a divorce in the usa than say annulment. This is the reason a lot of people would just settle for this than move through the rougher battle of getting an annulment. The only tough thing about this procedure is when it involves infant custody. More often than not, the battle for custody is what makes the process hard. An annulment, alternatively, declares the marriage null and void. In affirming this, the marriage will be declared to have not happened at all! Usually, the terms that may make an annulment possible are not as easy like for example, marriage when you are underage and there is no consent from the parents for the marriage or when the marriage was held under false pretenses. Generally, these conditions include falsehoods, non-declaration of legal commitments or not staying with the legal terms of marriage. Legal separation can be regarded as a notch below divorce with regards to the removal of all legal obligations and duties. It's nevertheless tougher to get one. In legal separation, the couple agrees to reside apart but will continue to support each other and have legal commitments to one another. Just like married couples, their assets are still bound together. Also, they are not permitted to marry somebody else until they obtain a divorce or an annulment.
