Barristers are legal experts. They may give expert legal opinions on any niche area of law. They can draft pleadings. They may be expert witnesses. Barristers can also act as advocates before higher courts, while attorneys and solicitors only have access to these higher courts upon appeal. Barristers are not hired by clients. However, barristers can be retained by attorneys on behalf of their clients as advisers. Because of their specialized nature, there are fewer barristers in proportion to both attorneys and clients. Barristers sometimes work as legal consultants to large businesses. For example, barristers are often experts in financial law, corporate law, or patent law. The barrister chooses their area of specialization and then works as a consultant on these legal matters. One of the advantages of a barrister system is that almost all attorneys and solicitors must bring in barristers for any type of specialized case beyond filing family law motions and basic lawsuits. Barristers can provide legal opinions in the form of briefings, friend of the court motions, and advisories. They can also argue the points a solicitor has made before the court. Attorneys can hire multiple barristers based on the complexity of a case. If a barrister is found inadequate or lacking expertise in the case, they can be replaced. This gives clients more flexibility and support for complex cases. Attorneys and solicitors can file litigation on behalf of their client. Attorneys can also stand in the place of their client in court, replacing the client if they do not want to or cannot be present. A barrister does not have this authority. They can only act when the solicitor asks them to do something. However, an attorney or solicitor can also be a barrister. In this case, their business card would state “solicitor and barrister” or “attorney and solicitor”. There are also “public access barristers” who have earned the right to work on some types of public cases in the UK. Barristers are used in common and English law systems around the world. In Japan, barristers are called scriveners. In Scotland and South Africa, barristers are called advocates. Canada calls barristers litigators. In France, they are called consultants or plaignant, but can also be called advocats or advocates. Barristers in Hong Kong, China, may have the title Senior Counsel if they had earned barrister status while the area was a British territory. Barristers in Northern Ireland are called Barrister-at-Law.
