Employment laws have been defending the rights of the employees and this is the reason why employers should think very carefully before doing anything that may hurt the workers. Termination is really a big issue, but employment laws will always make sure that the employers are getting the work that they need from the workers. Employment laws will almost always be in favor of the workers, but there instances where the employers will have the chance to decide by themselves, especially when it is about termination. If you are an employer, below are a few of instances where termination will be legal.

Poor performance can be a reason to terminate your employees. However, you can't do this immediately when they had a poor performance. You need to warn them first about their performance and ask them to make the necessary adjustments on their work.

You can also attempt to transfer them to a new department because it is possible that they're not fitted for the job. If the performance of the workers won't improve despite your efforts to make it work, you are able to terminate them.

You must always prepare some documents and reviews on their performance. This is really essential because a number of them will try to ask why they are terminated.

No one wants to work with people who will sexually harass them or hurt them physically and verbally so gross misconduct will surely be a big problem. You have the ability to stop your workers from doing unnecessary things on their co-workers. Obviously, you are able to terminate them if they won't follow the rules. Terminating them right away will not be a wise decision, but it will depend on the kind of thing that they did. If it is related to sexual harassment or someone is killed in your work place, termination needs to be done right away. Nonetheless, if the difficulty is not really big, it is possible to warn them first.

Being absent for some time will surely hurt the productivity of the organization so if your employee leaves work without warning, you can terminate them. This is certainly one of the reasons for termination.

If it happens that the workers don't have any clarification or documents that will prove that they really have a very good reason for not reporting to work, it is possible to terminate them instantly.

You need to still give them some notice, but you have the ability to do that and this is legal. The employment laws won't be a problem if the reason is legitimate.
