While some areas of live-in care work such as care with medication can be scheduled and recorded, most other tasks are agreed upon on a daily or hourly basis and is prone to changes very frequently. Such short burst and highly variable activities are not predetermined and often impractical to record on paper. Therefore, for the purposes of working time and wage regulations of a country, live in care jobs meets the criteria of ‘unmeasured’ time. If live-in care work stopped being seen as ‘unmeasured’ working time, the cost of such a service would round up to almost four times the current costs. As a result, hiring the services of private live in care would become extremely expensive for most of those requiring the service. The consequences of this would be that local authorities such as a live in care agency would reduce the support hours given to individual service users because the authorities are unable to absorb the high costs of the service. Furthermore, many individuals would not be able to enjoy the privileges of private live in care and as a result, would leave such individuals isolated in their homes for a long period of time. Such individuals would then be forced to move towards institutional care for themselves. As a solution to this, appropriate expectations should be established on all sides. The providers of this service should roughly agree on a maximum limit of ten hours per day of working with an individual in his home. Out of these ten hours, nine hours would be during waking hours and one hour may be kept as a buffer in case of night duty calls. Contracts should be used to set out these terms and conditions to the service user as well as the live-in carer. The wages should be calculated on a daily or weekl.y rate based on the ‘daily average hours’ worked per day. In any situation, if working time exceeds the agreed upon terms, overtime could be paid to the worker and such situations should be resolved between the two parties in an understanding manner. In cases where a live in care agency is introducing a worker to a service user, they should be offered on fixed term employment to the service user. The service user should also be aware of the of the expected number of hours that the live-in carer will work for them and the pay rate based on daily average hours worked should also be pre-calculated and both parties should be informed.
