What if your goal is to improve your credit report and there are judgments on it? If a judgment you owe was a default judgment, you might attempt to vacate that judgment. When you already satisfied or paid off your judgment, you have to mail proof of that satisfaction to the credit bureaus (agencies). Fixing or reporting erroneous judgment statuses to the three credit bureaus isn't a responsibility of the judgment owners, the courts, or the credit bureaus. No one will fix or investigate anything until you start making something happen. Begin by ordering a fresh copy of your credit report from the big 3 credit bureaus: Experian, Transunion, and Equifax. Try AnnualCreditReport.com to order a free credit report from each credit agency. Beware of certain other websites that promise "free" credit reports, but come with sneaky charges. This article is my opinion and is not, legal advice. I'm a judgment referral expert, and not an attorney. If you ever want a strategy to use or legal advice, please retain an attorney. When you have the credit report, review the report carefully to make sure that all the information on your judgments and debts, and all payments made on them, is correct. If something isn't correct and you do not owe what is listed, you can try to correct your record by sending in a credit dispute report. When you do that, file the debt dispute form at each of the top three credit agencies. If a judgment against you was won by default, and you did not get served notice of that lawsuit, and you wish to claim that judgment was a surprise to you; you could try to get that judgment vacated for lack of proper service. This requires a new court hearing, and your judgment owner needs to get served notice of the scheduled hearing. If you do persuade a judge you were not served properly or served at all, you might be successful and have your judgment set aside. Keep in mind that even if you succeed, nothing prevents the original judgment from suing you once again, buy many judgment owners won't. If you have a court ruling setting aside or vacating your judgment, send this proof to the credit reporting agencies. What if your judgment got turned over to a judgment enforcer or a collection agency or an attorney? In this case, you will need to work with whoever currently owns that judgment against you, or whoever currently represents the original judgment creditor. If your judgment was not won by default, or you cannot get it set aside, you could try to settle with the judgment owner, for a fraction of what is owed; and that is worth trying. Be sure you get all agreements reached with your creditor in writing; so that you can provide the top 3 credit bureaus with a copy of the credit account settlement and/or the judgment satisfaction. When the judgment is satisfied, the credit agencies will report the judgment as being settled and/or paid. In general, judgments and other less than perfect items, remain on credit reports for seven years. They can stay on your credit report for seven years, however it is not mandatory that they will. To get judgments and other debts eliminated or marked as getting repaid in full, you must first get them paid or set aside, and then dispute them in writing and provide proof; because certain people lie. If you persuade a credit bureau to begin an investigation, they'll contact your creditor. If your creditor doesn't respond, the bureau will probably remove that entry. If you can prove it, a satisfied judgment may be taken off your credit report, or at least it will show up as being repaid fully. If you satisfied a judgment, and your creditor didn't file that satisfaction at the court, first remind the creditor that the law says, the creditor needs to file it at the court. If the judgment owner won't satisfy your judgment after getting paid, you might have to sue the creditor in court, showing proof that you paid the creditor or the court, and if possible, that your judgment owner took your payment as settling your judgment debt completely. When you prove to the credit agencies that you satisfied a judgment, it may still appear on your credit report, but it will appear as being repaid.
