In my job, I get a bunch of e-mails and telephone calls with concerns on judgment-related paperwork and contracts. Each judgment buyer, judgment enforcer, collection agency, or collection lawyer needs to use paperwork to do business. My articles are my opinions and are not, legal advice. While a judgment might be, virtually no judgments are won at swap meets. Judgments are legal documents, and judgment recoveries and purchases always require contracts or agreements, and occasionally additional paperwork too.

I've had the same kinds of experiences and discussions with judgment creditors about a hundred times each week. I find everyone wants to find a judgment buyer. Everyone starts out trying to get big money upfront. The problem is, each judgment is actually a judgment situation involving the situation of the debtor. Most creditors start out looking for a lot more money upfront than what anyone is willing to pay them for their judgment.

Most people that send me judgments, explain to their debtors are doing well or are rich. Yet, most of the time, after I check their judgment debtors out with public data records, I don't find any obvious assets. Judgment buyers are only interested in the debtors's current assets.

After I run most judgment situations past a few judgment buyers, usually they all say they are not interested, or they're only willing to pay a tiny amount of cash upfront for the judgment. When I break the news and reality to the creditors, most then begin a long journey to show me that I am wrong; and hardly ever succeed, unless their judgment debtors later acquire additional available assets.

I try to help every creditor sell their judgment, or have the judgment collected. I make my living providing folks the right judgment referrals, that results in them getting money for their judgments. The only way I can get paid is if my referrals help judgment owners receive money.

However, I refuse to waste anybody's time, especially my own. After I find a judgment buyer who will pay a judgment owner (e.g.) 3% of the judgment's listed value, very few judgment owners are going to be happy with that offer. When this happens, I then offer to find the creditor a 50/50 future pay solution. Most creditors say no, and then they go on their quest to attempt to be paid more cash up-front for their judgment, and usually never receive any cash for their judgment.

Some judgment creditors that aren't happy with an (e.g. 3% cash upfront buying offer, the most anyone would pay for their specific judgment circumstance), then go with my referral to use a future pay collection professional. If that recovery expert later gets the creditor (e.g) 50% of what is recovered over the following year, the judgment owner will be happy, and I will get paid a small referral fee from that judgment recovery expert's potential profit.

Every judgment owner that finds, or gets referred to a judgment buyer or a future-payment contingency recoveryprofessional; needs to sign their documents. Judgments get assigned, sometimes they are collected with a lawyer's retainer contract, and sometimes a recovery specialist or a collection company collects the judgments, when a judgment owner signs their paperwork.

Many judgment enforcement professionals get tired of judgment owners who won't sign their documents. When judgment owners get future-pay judgment recovery documents for the first time, often they refuse to sign it. After that happens, many judgment owners keep shopping, and during the next year or two, they get judgment-quote related documents from (e.g.) 10 other experts, only to find each of 10 of the other company's documents are even worse (more complicated) than that of the first expert.

Judgment (purchase and recovery) documents is fairly similar, and are most often based on what is right for their state. Usually, judgment buying agreements are much simpler than future pay recovery contracts. Every judgment purchases require a notarized assignment of judgment.

I work with thousands of companies and people who recover or buy judgments. Each of them requires documents. Some have simple documents, and others have more complicated documents. Often there are trade-offs, often the best solutions have the most complicated documents.
