TRUE STORY OF NEW DELHI: Can prosecution/police relies on different sets of bodies to collect forensic evidences in a case where there is only a single victim? Well this seems to be illogical question, which answer could be only `NO’. This is exactly what the defense lawyer in sensational Nitish Katara murder case today claimed before the Delhi High Court, which is hearing the appeal case, by making claim that the prosecution had relied on four different set of bodies to collect forensic evidences in an attempt to build case against three accused, Vikas Yadav, his cousin Vishal and their trusted body-guard, Sukhdev Pehalwan.Pehalwan’s lawyer Ravinder Kapoor argued before Justice Gita Mittal and J.R. Midha that the statements of key witnesses and forensic reports suggest that there were four-sets of bodies to collect evidences against the accused persons. He gave following four arguments to back his claims:First, the police’s `panchnama’ made on Feb 17, 2002 on recovery of a body (stated to be deceased Nitish) reveals that “there were injuries on his abdomen and knee-joint but nothing on head’;Second, the `post-mortem’ report conducted on Feb 18, 2002, however, opined that there was a `head- injuries’ but no `abdominal or knee-joint injuries’.Third, the victim’s mother Neelam Katara made statement before the police on Feb 21, 2002 that when she had identified the body, it had `right leg missing.Fourth, at AIIMS where body was later examined and sample extracted for a DNA examination, had stated that these were extracted from the `right leg’.But these are not the only `glaring’ contradictions that put question marks on victim’s identity. Kapoor highlighted another crucial point. He claimed that the prosecution had produced `finger-prints’ of deceased during trial in the lower court. However the forensic doctors at Bulandsahar mortuary where the body was initially examined, have opined that the victim’s fingers were badly burnt as such no `finger-prints’ could be obtained for `matching’. In fact due to these grave contradictions, the trial court has already pointed out that the finger-prints report seems to be `fabricated’.After putting the above facts, Kapoor claimed that the prosecution had not only `fabricated’ finger-prints but the entire case to `implicate’ the accused persons.Further arguments in the case will continue from Sukhdev’s lawyer. Vikas and Vishal’s lawyers have already completed their arguments.By Our Correspondent Four bodies but one Victim for one case, How is this possible? this can only happen in a place like India where corruption works to its heights. Once you get in trouble in India then the police will chase you down putting unnecessary cases on you so they can finish the burden of unfinished workload. In this case the defense was able to point out four bodies when Nitish Katara was the only Victim. Its amazing how our system can over look all these fact and convict Vikas Yadav at the lower courts. This is the power of corruption in our country India within the highly educated and succesful families who have connections in high places of the private and government sectors. Eleven years of Vikas's precious life has gone to the dogs, and still they persist they have convicted the right person in this case. We need to wake up and take a stand on such matters like this where prisoners have not say in there case as they continue to remain imprisoned
