How Should A Judgment Get Paid?

Assuming that your judgment debtor is willing to voluntarily pay off your judgment, what's a good way of accepting payment and what location? Preferably, you'd not meet the judgment debtor in person, after the judgment was issued. The debtor might not be polite, or worse.

Usually, it is best to have the judgment repaid inside an envelope mailed to your post office box. Another good way to be paid on your judgment, without facing your judgment debtor; would be to ask your debtor pay a clerk of the court at the court house. Even those payment transportation methods have a few disadvantages; examples are, "The check is in the mail", and a clerk of the court may hold your funds for a certain period of time before you can receive it.

If the debtor insists on seeing you face-to-face, be sure that happens at some secure and public location. Do not get with the judgment debtor at your house, their house, or some store, or a restaurant. Good places to meet the debtor are at the courthouse or at a lobby of your regional Sheriff or Marshall. The goal is to benefit from the secure location, however not to bother the staff at the court house or Sheriff's lobby area.

Be sure the judgment debtor is paying you in full, because it's too inconvenient to keep getting with them with a partial payment. Ideally, one would get repaid, and that's all. In actual life, many folks like to hear their own voice. Often, judgment debtors have a duty to bend your ear about a bunch of info that you do not need to hear. Many times, a judgment debtor will complain about their original judgment creditor, or tell you they got ripped off and do not actually owe anything. Remind the debtor, that what is important is a judge decided the debtor owes the judgment. Let the debtor vent a bit, however do not let them wear you out.

What types of payments might you take? Your ideal option is a cashier's check issued by a bank. The bank is another fairly secure location to see a judgment debtor. And, you may have an advantage of watching them buy their cashier's check, which just about guarantees their check will not bounce. The next best payment method is a money order, from an issuer which you recognize.

Another payment choice is cash. Be certain it is genuine, and make sure to supply some kind of receipt, that is signed by both you and your judgment debtor, that specifies how much cash is paid. Be sure you both get copies of the signed receipt. A personal check from the judgment debtor works too; make sure to allow time to make certain that it clears, before satisfying the judgment. (Only) after you get paid for sure, promptly satisfy the judgment.

What if you can accept credit card payments, or have a PayPal account? The fine print on those contracts and agreements of merchant credit card accounts and PayPal, most often stipulate that account holders can't accept a payment toward satisfying judgments.

When the judgment debtor is a business, you can usually be a bit more calm about being paid. The larger and more successful the business, the more one can remain calm. When the business is big and profitable, you can meet with their financial person in their lobby, and take a check with no worry that it might bounce, etc. If the business isn't large and not profitable, you have to play it by ear.

Lastly, often judgment debtors agrees to repay you a specific amount before meeting you in person, and then attempt to ask for a surprise deal from you after the debtor meets see you face to face. This is not fair to you, and most likely they could pay you the amount the debtor first promised to pay you, if they wanted to. Use your own judgment in this kind of surprise deal circumstance.
