L2Networks filed the net neutrality complaint with the U.S. FederalCommunications Commission Tuesday, the first formal complaint sincethe FCC passed net neutrality rules in December 2010. L2Networks'filing comes after the telecommunications manager for the City ofAlbany Water, Gas & Light Commission, a municipal utility inGeorgia, filed a theft-of-service complaint with the DoughertyCounty Police Department in Albany earlier this year. Albany Water's assertion that the VoIP (voice over IP) providershould be paying for access to its fiber-optic network violates theFCC's net neutrality rules barring broadband network providers fromselectively discriminating against Web-based content and service,L2Networks said in a press release. If the FCC allows AlbanyWater's attempt to collect payments from L2Networks to moveforward, other broadband network operators may be emboldened toseek money from popular Web-based services such as Google, Facebookand Netflix, L2Networks said. The case could lead to an "irreversible ripple effect along withthe creation of various legal challenges across nearly everynational content and application provider," L2Networks CEO KraigBeahn said in a press release. "We are deeply concerned that thealleged claim could potentially change the landscape of thenational Internet marketplace as residential and commercialconsumers see it today." The two companies had a business relationship dating back to 2007that soured in 2011, Beahn said in an email. L2Networks has a"mountain" of documentation related to anticompetitive practices byAlbany Water, he said. "The real issue is the possibility that nearly any ISP can file atheft-of-service complaint if they feel another competitiveapplication service provider intrudes upon their territory orsimply wishes to remove such competition from the localmarketplace," he added. Officials with Albany Water did not respond to two email messagesand a voice mail message seeking comment on L2Networks' FCCcomplaint. A spokesman with the Dougherty County Police Departmentconfirmed that Albany Water has filed a theft-of-service complaintand said an investigation is ongoing. L2Networks, which provides voice and broadband service to about2,250 business customers in southwestern Georgia, also filed acomplaint against Albany Water with the Georgia Public ServiceCommission in March. The Georgia complaint also accuses AlbanyWater of temporarily locking L2Networks employees out of a networkbuilding leased from Albany Water while there were equipmentproblems inside the facility. L2Networks purchases ethernet transport from Albany Water in orderto serve its voice and Internet customers, Beahn said. Thetheft-of-service complaint stems from a single customer that usesL2Networks VoIP service over Albany Water's broadband service, hesaid.
