Being polite is one of those rare judgment recovery methods that cost nothing. Starting a recovery with politeness to the judgment debtor is easy, has very few risks, with may help you get paid. Prior to, during, and some time after the court process that caused their judgment; the judgment debtor might have been under stress. However, perhaps now, finding your relaxed, easy repayment proposal, in which you suggest compromising somewhat on the amount they owe, could be interesting the debtor. Diplomacy does not mean being a victim, or letting yourself get taken advantage of. Diplomacy means both parties are willing to negotiate to benefit both of them. Politeness requires some type of communication among the parties. Being diplomatic works best when your judgment debtor wants to communicate with you. Enforcing your judgment with politeness starts when one uses a telephone, the mail, or eventually arrange to discuss in person; how warm the debtor is to your idea of working with you, to solve the mutual dilemma of how to satisfy the judgment. If the debtor returns a phone call, or communicates a response to your communication, that is a good sign. Some judgment debtors that do not respond on the first try, might respond if you try again some time later. E-mail is ok, after you have first made contact with the judgment debtor another way, and you maintain good terms with them. Stay cautious on e-mail, keep it friendly and short when on topics related to the judgment. It's ok to discuss topics like sports or the weather. If using email, try not to share information that is private or discussing things in detail. Keep your discussions concerning judgments or debts as short and polite as possible. Discussions with judgment debtors by email should stay fairly close to general wordings like: "I got your check, thanks", "Didn't get the check yet, thanks", "OK, try to send a check if you can", "Call me please", or "I'll mail you a statement". It isn't helpful to get into conversations about whether or not the ruling of the court was proper or not. Be sympathetic and empathetic, yet politely remind the debtor it's the judge's order that counts. Remind the debtor it's is best to work toward the solution, instead of thinking about things that can't be changed. Any time you can convince a debtor to repay you willingly, it saves you money and time enforcing a judgment. With typical judgment debtors, perhaps try diplomatic discussions first. When the debtor is a professional scammer, you may want to quickly start with bold enforcement strategies, to catch them by surprise, before they can try to conceal their assets further. A fraud may try to hide their money. Last-minute asset hiding rarely fools courts or recovery specialists. The primary idea to present to your debtor, is that judgments earn interest, and judgments can get renewed, possibly till the cows come home. If they agree to begin paying with a lump sum or making payments, you can forgo part of the accrued interest, and save them a lot of recovery costs. Reaching an agreement with you, saves the debtor a lot of time, hassles, and cash. Sometimes a debtor is willing to pay, however doesn't have the money available to repay you. Payment plans can be the solution. Even the most optimistic judgment debtor can't predict the future. When your judgment debtor is poor, having the debtor pay what they are able to, when they can, should be your goal. Even when the judgment debtor has a job and/or income, is rare for them to consistently make (on time) long term payments. It's a good idea to get them to agree to contact you by phone, email, or mail every month; even if only to communicate they "cannot pay you this month".
